(sometimes called "Iliad", "we", "us" or "our" below) offers our mobile applications (collectively, called the "Mobile Application" below). These Terms & Conditions apply to your interaction with us. Your access to and use of the Site, including any content, information, materials, text, images, functionality, and services and products offered there, as well as your access to and use of the Mobile Application, including any of the foregoing offered on or through the Mobile Application, and your access to and use of any services offered by Iliad (collectively, called the "Services" below) is subject to these Terms of Service, together with any documents they expressly incorporate by reference (collectively, the "Terms of Service").We may revise these Terms of Service from time to time without notice. Please review these Terms of Service carefully on a regular basis, as they may have changed since your last visit.
Iliad provides a place for you to discover, track, and talk about books with friends and our community.Subject to your compliance with these Terms of Service and your payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the Services. This license does not include any resale or commercial use of any part of the Services, or its contents; any collection and use of any book listings, descriptions, reviews or other material included in the Services; any derivative use of any part of the Services or its contents; any downloading, copying, or other use of account information for the benefit of any third party; or any use of data mining, robots, or similar data gathering and extraction tools. All rights not expressly granted to you in these Terms of Service are reserved and retained by us or our licensors, suppliers, publishers, rightsholders, or other content providers. No part of the Services may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent.
You may not misuse the Services. You may use the Service only as permitted by law. The licenses granted by us terminate if you do not comply with these Terms of Service .By providing Iliad your email address you consent to our using the email address in accordance with our Privacy Policy.
Iliad may permanently or temporarily terminate, suspend, or otherwise refuse to permit your access to the Service without notice and liability for any reason, including if in Iliad’' sole determination you violate any provision of these Terms of Service, or for no reason. Upon termination for any reason or no reason, you continue to be bound by these Terms of Service .
The text, images, data, illustrations, files, audio and video clips, designs, documents, and other materials and content (collectively, the "Content") on the Site and the Mobile Application are the property of Iliad and its affiliates and licensors, and may be protected by copyright and other proprietary rights. You may not copy, modify, distribute or otherwise use any of the Content, except for your personal, non-commercial use. Please note that we may withdraw any Content from the Site or Mobile Application at any time in our sole discretion. By downloading, printing, or otherwise using any of the Content, you agree that you will (a) restrict your use of such Content to personal and noncommercial use, (b) comply with these Terms of Service, and (c) not violate the rights of Iliad or any other person or entity. Unauthorized commercial publication or exploitation of Content is prohibited without our express written consent. If you wish to use any of the Content in any way other than as authorized by these Terms of Service, you must first obtain our written permission. We may, in our sole discretion, grant permission for such use on a case-by-case basis and we may charge a fee for such use.
In order to access certain portions of the Services or areas of the Site and/or Mobile Application, you may be required to create a user account (a "User Account"). You may never use another party’s User Account without such party’s express written authorization. You represent, warrant and agree that all information which you provide through any portion of the Site and/or Mobile Application in connection with creating your User Account is and will be current, accurate, legally compliant and complete.You are solely responsible for all use connected with your User Account. You are solely responsible for maintaining the security of your User Account login credentials (username, Multi Factor Authorization (MFA) access authentication codes, etc.). You agree to notify us immediately of any security breach or unauthorized use of your User Account. We will not be liable for any costs, losses, claims or damages that you or any third party incur which are directly or indirectly caused by any unauthorized use of your User Account, except where such unauthorized use is the direct result of our gross negligence or willful misconduct.
Names, titles, trademarks, service marks, and logos (collectively, the "Trademarks") displayed on the Site and/or Mobile Application are our registered and/or unregistered common law trademarks or those of our affiliates and licensors. Nothing contained on the Site and/or Mobile Application should be construed as granting, by implication or otherwise, any license or right to use any Trademark displayed on the Site and/or Mobile Application without our express written permission or that of the third party that owns the Trademark. Any unauthorized use of the Trademarks is prohibited.
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Service, please send us the following information:
1) An electronic or physical signature of a person authorized to act on behalf of the copyright owner;
2) A description of the copyrighted work that you claim has been infringed upon;

The Site, the Mobile Application and the Services are only available only to, and may only be used by, individuals who are thirteen (13) years of age or older, and any registration, use or access to the Services by anyone under 13 is unauthorized, unlicensed, and in violation of the Terms of Service. If you are under 18 years of age you may use the Services only if you either are an emancipated minor or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in the Terms of Service, and to abide by and comply with the Terms of Service .
The Site, the Mobile Application and the Services may contain links to third-party websites. The linked sites are not under Iliad’s control and we are not responsible for the contents of any linked website. These links are provided as a convenience only and shall not be construed as our endorsement of, sponsorship of, or affiliation with a linked website. The Site, the Mobile Application and the Services may also contain links to the email addresses of various employees or other service providers for purposes of feedback and communication regarding Iliad and our products and services. Purchases made with our associated affiliate booksellers such as Bookshop.org, Amazon, publishers, authors, and curators may qualify for shared referral revenue to ILIAD. If you would like to request additional booksellers on ILIAD, please send us your requests to info@iliad.co. By clicking on a link to an employee’s or other service provider’s email address, you may leave Iliad and enter into an area, such as one controlled by your email service provider, which these Terms of Service do not govern. We assume no responsibility or liability with respect to your entering such area.
If you arrive at the Site and/or the Mobile Application from a third-party link, please note that such link to or solicitation for the Site and/or the Mobile Application does not imply a relationship with, or endorsement of, the third-party website, application, etc. or its content, purpose, policies or practices.
From time to time, the Site, Mobile Application, and/or Services may be inaccessible or inoperable for various reasons, including equipment malfunctions, updates, maintenance and repairs and causes beyond our control or those that are not reasonably foreseeable. We are not obligated to compensate you for these conditions.

You understand and agree that any loss or damage of any kind that occurs as a result of the use of any User Content that you post is solely your responsibility. Iliad is not responsible for any public display or misuse of your User Content. You understand and acknowledge that you may be exposed to User Content that is inaccurate, offensive, indecent, or objectionable, and you agree that Iliad shall not be liable for any damages you allege to incur as a result of such User Content. Iliad may provide tools for you to remove some User Content, but does not guarantee that all or any User Content will be removable.
By posting any User Content on the Site, the Mobile Application and the Services, you expressly grant to Iliad a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display such content throughout the world in any media. Except for your User Content, the Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and User Content (the "Iliad Content"), and all intellectual property Rights related thereto, are the exclusive property of Iliad and its licensors. Except as explicitly provided herein, nothing in the Terms of Service shall be deemed to create a license in or under any such intellectual property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from any materials or content accessible on the Services. Billing Policies. Certain aspects of the Services may be provided for a fee or other charge. These fees and charges, if any, are described on the website. If you elect to use paid aspects of the Services, you agree to the pricing, payment and billing policies applicable to such fees and charges, posted at the website. Iliad may add new services for additional fees and charges, or amend fees and charges for existing services, at any time in its sole discretion.
THE SERVICE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. ILIAD MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICE, OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE, UNLESS OTHERWISE SPECIFIED IN WRITING. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, ILIAD DISCLAIMS ALL WARRANTIES,EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ILIAD DOES NOT WARRANT THAT THE SERVICE, INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE, ILIAD’S SERVERS OR ELECTRONIC COMMUNICATIONS SENT FROM ILIAD ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ILIAD WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE SERVICE, OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
You agree to indemnify and hold the Iliad Parties harmless from any loss, liability, claim or demand, including reasonable attorneys’ fees and costs, due to or arising out of (a) your breach of these Terms of Service; (b) your violation of any third-party right; and (c) your gross negligence, intentional misconduct and illegal conduct.
We specifically reserve all rights that we do not expressly grant in these Terms of Service.
You agree that these Terms of Service (including, without limitation, the Privacy Policy) constitute the entire agreement between you and us with respect to your use of the Site, Mobile Application, and/or Services. You agree that these Terms of Service supersede any other agreements between you and us with respect to your use of the Site, Mobile Application, and/or Services.
We reserve the right to modify, change, or add terms, or features of the Mobile Application or Site at any time, and at our sole discretion. Any additional terms that we may provide to you will be incorporated by reference into these Terms and will become effective from the date they are posted on the Site. To the extent any additional terms conflict with these Terms, the additional terms will control.
